Welcome to the Shen Yun Arts Proficiency Assessment Center. We treat your privacy seriously. This Privacy Notice (Notice) describes how Shen Yun Arts Proficiency Assessment Center, Inc. collects, uses, and shares information about you through our online interfaces that we own and control (Site). Specifically, it explains what personal data we collect, how and why we use or collect them, and how and when we share, retain, or delete certain personal data. We will also explain in this Policy what your rights and controls are concerning our treatment of your personal data and how we keep your personal data safe.

The personal data we collect includes account registration such as name and email; details of the content you review, create, or provide to us; identity verification data; and information about your use of our Site and the Services we offer (Services).

We use your personal information to provide our Site and Services to you, ensure the security and performance of our Site, and perform statistical analysis of the use of our Site and Services.

You have the right to update or delete the personally identifiable information that we collect from you.

Our Terms of Use also govern your use of our Site and Services. Terms used but not defined in this Privacy Notice can be found in our Terms of Use.

What Information We Collect

To access certain features and benefits on our Site, you may need to submit "personally identifiable information" or "personal information" (Personal Data). Personal Data includes information such as your name, email address, IP address, and device identifier, among other things.

We gather the following types of information about users through the Site:

  • Information relating to your use of our Site. For example, when users come to our Site, we may track and collect information about which pages of our Site were visited, the order in which they were visited, and the URLs from which you linked to our Site. We may also use cookies and web beacons when you visit our Site.

  • Personal Data provided directly by you or via third parties. We collect Personal Data that you provide to us when you register for an account, verify your identity, update or change information for your account, purchase products or Services, complete a survey, sign-up for email updates, send us email messages, send us audio-video files, and/or participate in the Contract Instructor Partnership Program or other Services on our Site. To enroll for these Services, you may be required to provide us or our third-party identity verification vendor with Personal Data such as your name, address, date of birth, and a photo identification document.

  • Participation in Contract Instructor Partnership Program. If you participate in our Contract Instructor Partnership Program, we may collect certain user-generated content, such as courses you create, materials you upload, assignments you submit. We also collect course data, such as responses to exams. You should not include any Personal Data or other information of a personal or sensitive nature, whether relating to you or another person, on assignments, or exams, except for information required to participate in or submit such assignments or exams.

  • Third-Party Payment Processing. We provide you with the ability to pay for courses and other Services using a credit card or other methods through a third-party payment processing service provider. Please note that our service provider – not us– collects and processes your financial information.

You are responsible for the accuracy of the Personal Data you submit to us. Inaccurate information may affect your ability to use the Site, the information you receive when using the Site, and our ability to contact you.

How We Use the Information

We use your information as follows:

For information relating to your use of our Site, we use information about your use of the Site to improve our Services. For example, we may perform statistical aggregate analyses and may identify demographic interests in specific areas of our Site.

For Personal Data provided directly by you or via third parties, we will not disclose any of your Personal Data without your authorization, except as set forth in this Privacy Notice. In addition to the uses set forth in this Privacy Notice, we may disclose and otherwise use Personal Data as follows:

  • Providing you with access to and use of the Site and our Services.

  • Providing you with technical support and security.

  • Providing you with access to and participation in our Contract Instructor Partnership Program. We may also share your Personal Data and your performance in a given course with the course instructor(s) who created and taught the course, teaching assistants, or other individuals designated by the instructor(s) to assist with the creation or teaching of the course.

  • Verifying your identity. We may use your Personal Data to verify your identity and authenticate your submissions on the Site.

  • Communications with or from us.

  • Disclosure to our affiliates and contractors who provide technology, services, and/or content related to the Site or the Contract Instructor Partnership Program to the extent reasonably necessary for them to assist us in providing our Services to you.

  • Complying with the law.

EEA Residents

If you reside or are located in the European Economic Area (EEA), the following are legal bases for using your personal information when it is necessary:

  • to perform our obligations under our contract with you and for you to perform your obligations as well, for example, to comply with the Terms of Use and to provide Services to you;
  • to comply with our legal obligations;
  • for our legitimate interests or the legitimate interests of others to run and develop our business; provide you our online Services; select qualified instructors; build relationships with partners; conduct research and statistical analysis; conduct marketing and business development; and for internal administrative and auditing purposes.
  • to consent, to send you certain communications, where you submit certain information to us, or where required to rely upon consent by local law.

Which legal basis applies to a specific use depends on the type of personal information used and the context in which it is being used.

Retention of Personally Identifiable Information

We retain your Personal Data for no longer than necessary for the purposes for which the Personal Data is collected and processed. We also retain Personal Data to the extent that we are required to comply with applicable laws and to establish, exercise, or defend our legal rights.

Confidentiality & Security of Personally Identifiable Information

We will not share Personal Data with third parties, except as otherwise provided in this Privacy Notice, or unless such disclosure is necessary to protect the safety of you or others to the extent it is permitted by applicable law. We will keep your Personal Data confidential and secure in accordance with industry standards for physical, technical, and administrative security. However, we cannot guarantee the security of Personal Data. There is the risk of security breaches by an unauthorized third party affecting our security systems. Transmission of your information over the Internet may be intercepted. It is your responsibility to protect your login information.

Updating or Deleting Your Personal Data

You have certain rights in relation to your Personal Data. You can update your Personal Data. You can also change your profile to opt-out or withdraw your consent for us to use your Personal Data as described in this Notice. You can request that we delete or provide you with a copy of your personal data.

For those who reside or are in the EEA, the United Kingdom, Switzerland, or other regions that offer similar protections, you have the right to request that we:

  • provide access to any Personal Data we hold about you;
  • prevent the processing of your Personal Data for direct marketing purposes;
  • update any Personal Data which is out of date or incorrect;
  • delete any Personal Data which we are holding about you;
  • restrict the way that we process your Personal Data;
  • provide your Personal Data to a third-party provider of services; or
  • provide you with a copy of any Personal Data which we hold about you.

When you email us with a request, we may ask that you provide us with the information necessary to confirm your identity.

California Privacy Rights

Under California's "Shine the Light" law, California residents who provide personal information in obtaining products or services for personal, family, or household use have the right to request and obtain from us, once a calendar year, information about the customer information we shared for the immediately prior calendar year, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information. To obtain this information, please send an email message to apac_help@shenyunzuopin.com  with "Request for California Privacy Information" in the subject line and the body of your message. In response, we will provide the requested information on covered sharing to you at your email address.

Under the California Consumer Privacy Act, California residents also have the right to know what personal information about them is collected, request deletion of their personal data, opt out of the sale of their personal data, and not be discriminated against if they choose to exercise any of these rights. We do not sell any of the data we collect about you.

Updating Our Privacy Notice

We may update the Private Notice from time to time without notice. Such updates will be effective immediately upon posting on our Site. We encourage you to visit this page and review the most up-to-date version.
